Regulations of the Online Bookshop of the State Museum at Majdanek
- 1 Introductory provisions
- The Regulations include:
- rules for the conclusion of sales agreements,
- rules on the termination of sales agreements,
- terms and conditions for the provision of services by electronic means,
- by means of the Online Bookshop operated at the address: majdanek.eu by the State Museum at Majdanek, with its registered office in Lublin (20-325) at Droga Męczenników Majdanka 67, entered into the Register of National Cultural Institutions under the number P-0276096-3400000053-1-831-43101 according to the extract from the registration book RNIK 30/92, NIP (Tax Identification Number) 946-00-01-052, REGON (Statistical Identification Number) 000276096, hereinafter: the Seller.
- The use of the Online Bookshop is not possible without prior acceptance of the Regulations.
- The content of the Regulations and any amendments thereto are available at: ksiegarnia.majdanek.eu.
- 2 Definitions
- Price – gross price of the Goods placed next to the information about the Goods, not including the costs of delivery.
- Order lead time – the time during which the Seller accepts the Order, packs and dispatches the Goods.
- Supplier – Poczta Polska S.A. or InPost sp. z o.o. – entities delivering the ordered Goods.
- Proof of purchase – the original VAT invoice delivered with the Goods
- Electronic Order Form – the form available on the Online Bookshop website for placing Orders.
- Customer – a natural person over 18 years of age with full legal capacity, as well as a legal entity or an organisational unit without legal personality that places an Order.
- Consumer – a customer who is a natural person and who makes a purchase for a purpose that is not related to professional or business activity.
- Cost of delivery of the Goods – the value of delivery of the Goods to the Customer, as determined by the Supplier.
- Cart – the functionality of the Online Bookshop that displays the Goods selected by the Customer for purchase.
- Online Bookshop – Internet service, available at the address: majdanek.eu allowing the Customer to purchase Goods,
- Bookshop Assistant – an employee of the museum assisting and supporting the Customer with specific needs during the search, selection and purchase of Goods, as well as providing answers to questions about the offer and the manner of processing orders
- Declaration – Declaration of withdrawal from a remote sales agreement.
- Order Confirmation – an email with the subject ‘Order Confirmation‘ sent to the Customer's address.
- Entrepreneur with Consumer Rights - natural person concluding a Sales Agreement directly related to their business, when the content of the Sales Agreement shows that it does not have a professional character for them, resulting in particular from the subject of their business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity.
- Regulations – these Regulations of the Online Bookshop.
- Goods – book publications and other items for sale in the Online Bookshop.
- Digital Content - content produced and delivered in digital form not recorded on a tangible medium, delivered by the Seller via the Online Bookshop to the Customer upon payment of the Price. Whenever the regulations refer to Goods, it also refers to Digital Content, unless the content of a given provision indicates otherwise.
- Agreement for the Provision of Digital Content – an agreement, concluded with the use of means of distance communication and concerning the provision of Digital Content by the Seller to the Customer against payment of the Price. Whenever these Regulations refer to a Sales Agreement, this shall also refer to an Agreement for the Supply of Digital Content, unless the content of a particular provision indicates otherwise.
- Sales Agreement – an agreement within the meaning of Article 535 of the Civil Code et seq.
- Order Value – the Price of the Goods increased by the cost of delivery of the Goods.
- VIES Number – an electronic means of transmitting information related to VAT registration of entities registered within the EU, through which information on intra-Community supplies exempt from the right of deduction is exchanged.
- Order – a declaration of intent made by the Customer specifying the type and quantity of Goods, submitted electronically through the Online Bookshop.
- 3 Method of concluding the Agreement, order cancellation, processing of the order.
- The Seller informs about the following technical requirements necessary to conclude the Sales Agreement via the Online Bookshop:
- Internet connection,
- use of computer software that allows the Online Bookshop to be used.
- All information concerning the Goods placed in the Online Bookshop, including advertisements, price lists or other information materials are commercial information and do not constitute an offer within the meaning of the law, but are only an invitation to conclude a Sales Agreement under the conditions described in the regulations.
- Declarations of intent shall be made electronically, in particular by e-mail.
- Sales agreements are concluded only within the limits of the commercial information published on the Online Bookshop.
- The conclusion of the Sales agreement requires the prior provision of personal data:
- filling in the Electronic Order Form available online at majdanek.eu.
- communicated by telephone, but following an exchange of confirmations by e-mail, sent and received from the following address:ksiegarnia@majdanek.eu
- Online Bookshop orders can be placed 24 hours a day throughout the calendar year provided that Orders placed after 4 p.m. and on public holidays shall be deemed placed on the next working day.
- The Seller informs about availability and price of the Goods in their description.
- The prices of the Goods indicated in the Online Bookshop:
- include VAT and are given in Polish zloty
- do not include delivery costs.
- Conclusion of the Sales Agreement requires compliance with the guidelines available at ksiegarnia.majdanek.eu.
- Costs associated with the Order are given by the Seller in the Shopping Cart available at ksiegarnia.majdanek.eu.
- The Sales Agreement is concluded at the moment of confirming the acceptance of the Order by the Seller. The condition for placing an Order is the availability of the Goods in the Seller's warehouse.
- Confirmation of the Order is sent only to the e-mail address provided to the Seller.
- The order is accepted by e-mail, from the bookmark with the address: ksiegarnia.majdanek.eu.
- If processing of the whole or part of the Order is impossible due to the unavailability of the Goods, the Seller shall, within 7 days from the conclusion of the Sales Agreement, notify the Customer of this fact and return the entire Price received within 14 days.
- If the Seller cannot execute the Sales Agreement due to even a temporary inability to sell the Goods with the properties ordered by the Customer, the Seller may, within 7 days from the conclusion of the Sales Agreement, execute it by supplying Goods of the same quality and for the same purpose, for the agreed Price, notifying the Customer in advance of their right to refuse such Goods and at the same time the right to withdraw from the Sales Agreement with a refund of the Price paid and the Goods, at the Seller's expense.
- The Customer has the right to cancel the Order without giving any reason after receiving an e-mail from the Seller with the title Order Confirmation.
- Cancellation of the Order is not possible after the Seller has sent it to the Customer.
- The Order is cancelled by sending a Declaration to ksiegarnia@majdanek.eu.
- The ordered Goods are delivered with a VAT invoice constituting a proof of purchase.
- By accepting the regulations, the Customer agrees to receive invoices in electronic form and sending them by e-mail in a PDF format.
- Legal entities from the European Union (outside Poland) with an active VIES number should contact the Bookshop staff by e-mail (ksiegarnia@majdanek.eu) before making a purchase in the Online Bookshop.

- 4 Price and method of payment
- The price of the Goods is given in Polish zloty and is a gross price.
- The Seller reserves the right to change prices of the Goods on offer, introduce new Goods and modify the existing ones.
- The price of the Goods is the binding and final price given on the Online Bookshop website at the moment of placing the Order by the Customer, additionally confirmed in the shopping cart and in the e-mail confirming the acceptance of the Order. Information on the total amount of payment, including the cost of delivery of the Goods, if any, is presented after the Customer has selected the form of delivery of the Order and the form of payment.
- Shipping costs shall be added to each Order.
- Personal collection of the Product by the Customer is free of charge. The Products can be collected at the registered office of the seller: Państwowe Muzeum na Majdanku (State Museum at Majdanek), Droga Męczenników Majdanka 67, 20-325 Lublin.
- In the case of an order conducted in the territory of the Republic of Poland, the Seller accepts the following types of payment for the ordered goods:
- prepayment to the Seller's bank account administered by:
Bank Gospodarstwa Krajowego 93 1130 1206 0028 9173 9720 0001; - electronic payment through the Przelewy24 company system. The entity providing online payment services
for instant transfer payments is Autopay S.A / PayPro S.A. - card payment. The operator of payment cards is PayPro S.A. Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, 8th Economic Division of the National Court Register under National Court Register number 0000347935, NIP (Tax Identification Number) 7792369887, REGON (Statistical Identification Number) 301345068.
- Payments for Orders executed outside the borders of the Republic of Poland are possible only by card payment. The operator of payment cards is PayPro S.A. Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, 8th Economic Division of the National Court Register under National Court Register number 0000347935, NIP (Tax Identification Number) 7792369887, REGON (Statistical Identification Number) 301345068.
- 5 Discount
Customers making a one-time purchase of the Goods in the Online Bookshop for the amount exceeding PLN 300.00 gross are entitled to a discount in the amount of 10% of the gross price of the purchased Goods.- The Seller reserves the right to introduce discounts other than those specified in § 5, which are limited in time and addressed to limited Goods or Customers.
- 6 Order lead time
- The commencement of processing of the Order shall depend on the method of payment:
- in the case of prepayment to the Seller's bank account, it shall take place no later than 5 working days after receipt of the Price increased by the Delivery Cost of the Goods;
- in the case of orders paid via electronic payment in the Przelewy24 system or card payment, it takes place no later than within 5 working days from the moment of authorisation of the electronic payment or card payment on the website of the Seller's partner – PayPro SA company (Przelewy24).
- The processing of the Order consists of:
- acceptance of the Order for processing;
- picking of the Order;
- packaging of the ordered Goods;
- shipment of the ordered Goods.
- The Seller reserves the right to temporarily suspend the execution of Orders.
- In each case of occurrence of the circumstances referred to in § 6 section 3 of the Regulations, the Seller shall place information on the website: ksiegarnia.majdanek.eu about the period of suspension of the fulfilment of Orders.
- 7 Method of delivery
- The ordered Goods are delivered by the Supplier chosen by the Customer within the time limit and at the cost according to the price list of a given Supplier.
- The packed Goods are sent to the address indicated by the Customer in the Electronic Order Form. The Customer has the option of indicating a different delivery address by filling in the box ‘Shipping details’.
- The cost of delivery of the Goods depends on:
- the gross weight of the Goods;
- the place of delivery – in case of delivery outside the Republic of Poland;
- choice of Supplier;
- choice of delivery method.
- 8 Complaints
- Within the limits of generally applicable provisions of law, the Seller shall be liable to the Customer – for non-compliance of the Goods with the Sales Agreement, i.e. physical defects, on the rules set out in the Civil Code Act of 23 April 1964 (i.e. Journal of Laws of 2024, item 1061, as amended).
- The complaint should be made in writing. A written complaint shall be submitted to the Seller's address. The claimed Goods and the Proof of purchase should be attached to the complaint.
- The Seller responds to the complaint within 14 days of receipt.
- The complaint should contain a description of non-compliance of the Goods with the Sales Agreement, physical defect and specify the expected manner of its removal.
- The costs associated with the shipment of the claimed Goods shall be borne by the Seller. They are reimbursed within 14 days of acceptance of the complaint.
- If the complaint is considered justified, the Goods are exchanged for other defect-free Goods. If the replacement is not possible because the Goods are out of stock, the Seller shall return the value of the order of the claimed Goods to the Customer.
- 9 Right of withdrawal from the Sales agreement
- If the Agreement has been concluded via the Internet or outside the registered office of the Company, the Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the Agreement within 14 days from the date of receipt of the Goods. The Customer does not have to give a reason for withdrawal, but must pay the additional costs of delivery if the Customer has chosen a more expensive delivery method than the cheapest available delivery method offered by the Seller. The right of withdrawal from the Digital Content Sales Agreement is subject to § 10 of these Regulations.
- In order to withdraw from the Agreement, the Consumer or Entrepreneur with consumer rights should submit to the Seller a declaration of withdrawal from the Sales Agreement along with sending the Proof of Purchase, its copy or at least giving the Order number, and then immediately return the Goods in an undamaged condition to the address of the State Museum at Majdanek in Lublin:

- A Consumer or Entrepreneur with consumer rights may use the template of the Sales Agreement withdrawal form found at: ksiegarnia.majdanek.eu. The use of the template form of withdrawal from the Sales Agreement is not mandatory.
- The template of the Agreement withdrawal form, together with detailed instructions on the right of withdrawal from the Sales Agreement, is sent by the Seller to the Consumer or Entrepreneur with consumer rights each time with confirmation of the terms of the Order placed, both in the form of e-mail to the address provided by the Customer when placing the Order and in writing (paper) with the shipment.
- Immediately upon receipt of the declaration of withdrawal from the Sales Agreement, the Seller shall send to the Consumer or Entrepreneur with consumer rights a confirmation of its receipt in writing or to the e-mail address provided by the Customer in the declaration.
- Return of the Goods shall be made no later than 14 days from the day on which the Consumer or Entrepreneur with consumer rights has withdrawn from the Sales Agreement.
- In the event of effective withdrawal from the Sales Agreement, the agreement shall be deemed not to have been concluded and the Withdrawing Party shall be released from all obligations.
- The Goods shall be returned at the expense of the Withdrawing Party.
- Effective withdrawal from the Sales Agreement shall mean that the Seller shall refund the Selling Price and the Delivery Cost of the Goods.
- The Seller shall refund the payment, without delay, no later than within 14 days of receipt by the Seller of the declaration of withdrawal from the Sales Agreement, using the same method of payment used by the Consumer or Entrepreneur with consumer rights, unless the Consumer or Entrepreneur with consumer rights expressly agrees to a different method of return that does not involve any costs for the Seller.
- The Seller reserves the right to withhold reimbursement of payments received from the Consumer or Entrepreneur with consumer rights until it has received the item back.
- The Consumer or Entrepreneur with consumer rights shall be liable for any reduction in the value of the item resulting from the use of the item beyond what is necessary to establish the nature, characteristics and functioning of the item. Digital media must be returned in their original, intact packaging (unremoved foil, undamaged box). If the packaging of the digital media is tampered with (removed foil, damaged box), the consumer or an entrepreneur with consumer rights does not have the right to withdraw from the agreement.
- 10 Digital content and agreement for the supply of digital content
- The Digital Content shall be made available to the Customer by e-mail immediately after the Order obtains the ‘Confirmed’ status in the form of an automatically generated link to download the Digital Content, as well as in the tab ‘My Account -> Order History and Details’.
- The right of withdrawal from the Agreement for the Supply of Digital Content shall not apply if the performance has begun before the expiry of the deadline for withdrawal from the Agreement, with the consent of the Consumer or entrepreneur with consumer rights, given during the purchase in the content of the purchase form. The consent to the performance before the expiry of the 14-day withdrawal period shall result in the loss of the right of withdrawal of the Consumer or the entrepreneur with consumer rights.
- Consent to the delivery of the Digital Content before the expiry of the withdrawal period shall be given by the Consumer or an entrepreneur with consumer rights making the following declaration:
- The Customer may submit a Digital Content complaint to the Seller in writing.
- The complaint shall be reviewed by the Seller within 14 days from the Seller's receipt of the Customer's complaint.
- 11 Processing of personal data
- The Controller administrator of the personal data is the Seller.
- By entering into the Sales agreement, the Customer consents to the processing of personal data.
- The storage, processing and transfer of the entrusted personal data shall be carried out in accordance with the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2019, item 1781) and these Regulations and pursuant to Article 6 section 1 letter b of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) – ‘GDPR’).
- The personal data provided by the Customer is processed exclusively for the purposes necessary to process the Order.
- The Seller guarantees and safeguards the Customer's right to unrestricted access to their personal data, the possibility to supplement, update, rectify, request to cease processing or delete personal data processed by the Seller on the rules resulting from the applicable legislation.
- The rules of obtaining, using, sharing and protecting personal data are included in the Privacy Policy, available on the Online Bookshop website of the State Museum at Majdanek.
- 12 Final provisions
- In matters not regulated in the Regulations, the provisions of the Civil Code and the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2023, item 2759, as amended) shall apply.
- The Seller informs that the Consumer has specifically the following possibilities to make use of out-of-court means of complaint processing and claim assertion:
- The Consumer may apply to the provincial inspector of the Commercial Inspection with an application to initiate mediation proceedings for an amicable settlement of the dispute between the Consumer and the Seller;
- A consumer may apply to a permanent amicable consumer court operating at the Trade Inspection to resolve a dispute arising from a contract concluded with the Seller;
- The consumer can use the ODR platform. The platform serves to resolve disputes between consumers and entrepreneurs http://ec.europa.eu/consumers/odr
- Consumers may obtain free assistance in resolving a dispute between them and a Seller by using the free assistance of a district (municipal) consumer ombudsman or a social organisation tasked with consumer protection (e.g. Federation of Consumers, Association of Polish Consumers). Advice is provided by the Consumer Federation at the toll-free consumer hotline number 800 007 707 and the website of the Office of Competition and Consumer Protection available at: http://www.uokik.gov.pl/wazne_adresy.php#faq596.
- The seller reserves the right to amend the Regulations. Amendments shall enter into force on the date specified by the Seller, but not earlier than 7 days after the amendment is posted on the website.
- Regulations are drawn up in two language versions: Polish and English. In case of discrepancies between the versions, the Polish version shall prevail.
